INTRODUCTION
Boma Sağlık Turizm a.ş. owns the HBT Hospital (“HBT”, “we”, “us”, “our”) website. You may access and use our website if you agree to be legally bound by the terms set out here. If you do not agree to be legally bound by these terms, please do not access and/or use the HBT Hospital website.
If you choose to log in to the HBT Hospital website, you are using your HBT account. By using your HBT account you are accepting our terms and conditions. These will apply while you are using services within your HBT Hospital account.
If you use the HBT Hospital website on behalf of someone else:
- these terms apply to your use;
- you are responsible for such access and use, including being responsible for compliance with these terms; and
- you must, to the extent possible, make the person you are using the HBT Hospital website on behalf of aware of: (i) your access and use and any steps you take on their behalf, and (ii) these terms.
- If the member is related to a patient (spouse, children, parents, and relatives), the affiliated member is responsible for the information he/she has entered on behalf of his/her related patient, and is responsible even for the payments, the examinations and treatments made on behalf of this patient. HBT hospital does not accept any responsibility.
HBT reserves its rights to amend, modify and update the terms and conditions, at any time, without any prior notice. The member may any time check the terms and conditions. If the members decide that the terms and conditions are not in their favor, they may cancel the membership immediately. No claim shall be raised against HBT due to any modifications and updates.
HBT hospital is a global online healthcare services provider. HBT makes this site available for the sole purpose of facilitating communications between health services providers and consumers who choose to use the online service.
USE OF OUR SERVICES IS NOT APPROPRIATE FOR EMERGENCIES. IF YOU THINK YOU HAVE A MEDICAL OR MENTAL HEALTH EMERGENCY, OR IF AT ANY TIME YOU ARE CONCERNED ABOUT YOUR CARE OR TREATMENT, CALL 911 OR GO TO THE NEAREST OPEN CLINIC OR EMERGENCY ROOM.
INFORMATION ABOUT THE ONLINE SERVICES OF HBT HOSPITAL
HBT HOSPITAL, enables the members to communicate, in electronic media, with healthcare staff they have chosen through the system; and benefit of online medical advisory service.
HBT HOSPITAL is global service provider, which, by means of its services, facilitates virtual communication through digital system, between healthcare staff and the members, regardless of their location in the world. The healthcare staff with whom the member communicates may be located in any country and/or state other than that of the member who wishes to benefit of the advisory services. Each healthcare staff personnel chosen through the system is licensed in their own country and/or state; and operates in accordance with local health regulations and legislation. It is recommended that, before choosing the healthcare staff personnel through the system, the member examine the medical education and the branch of the personnel, and the country where he operates.
The service provided to the members by healthcare staff via virtual communication is telemedicine service whereby general and advisory medical information is relayed.
HBT does not guarantee in any way that the virtually medical advices, diagnoses or information of the provided healthcare staff will be appropriate and suitable for the member’s medical status. It is entirely under the member’s initiative to benefit of online telemedicine service, or act in accordance with the medical advisory information provided by healthcare staff.
Online telemedicine service which is provided to the member by the healthcare staff is not an alternative to physical examination. Therefore, in circumstances where the healthcare staff may find out, diagnose, treat or assess critical points about the member, that could be based solely on physical examination, the member may not obtain anticipated benefit from the virtual communication. The member must, therefore, be aware of this vital information; and apply to the nearest health institution he would prefer in his location for physical examination, if he thinks is necessary.
The healthcare staff will, during the virtual communication, conduct assessment, only limited to the information provided orally or through documents uploaded to the system by the member, if any; due to which, the staff may not form complete, adequate or decisive opinion in respect of the member’s health status. Thus, the member who has read the explanations given multiple times and who has agreed to receive services may not, for any reason, claim any rights against HBT HOSPITAL and healthcare staff, relying on the medical advises provided by the healthcare staff.
It is entirely under the member’s own initiative to request virtual communication with healthcare staff over HBT system
The general and private data which will be provided to healthcare staff by the member during the virtual communication may neither be exported out of the system nor be disclosed to third parties in order to infringe personal rights.
During and after the virtual communication, the member may not tape audial or visual records of the communication, export it out of the system and disclose to third parties, in order to cause pecuniary and non-pecuniary damages, infringe personnel rights, or damage of healthcare staff.
THE MEMBER WHO WISHES TO BENEFIT OF THE ADVISORY SERVICES ACCEPTS AND UNDERTAKES THAT ANY INFORMATION AND/OR DATA HE HAS PROVIDED IN RELATION TO THE MEDICAL ADVISORY SERVICES ARE GENUINE, ACCURATE AND UP-TO-DATE.
For the purposes of the terms and conditions set out herein, the misleading information means any information which has intentionally, negligently or unknowingly been provided by any of the parties, in relation to the virtual communication, which leads to wrongful description or diagnoses of any health condition, or which leads to any loss or damage. In case of any act, deliberation or negligence concerning misleading information, HBT reserves the right to take all the legal actions and claim indemnity for damages, against the members or third parties who have caused it.
THE DOCTOR IS RESPONSIBLE FOR SUBMITTING A PROPOSAL FOR THE TREATMENT OR SURGERY, RESULTS, HOSPITAL ADMISSION, HOSPITALIZATION PROCEDURES, THE PROCEDURES APPLIED DURING THE TREATMENT OR SURGERY PROCESS, UNTIL THE DISCHARGE AND THE LAST FACE-TO-FACE EXAMINATION, AND HBT DOES NOT ACCEPT ANY RESPONSIBILITY.
In no event shall HBT be liable for any damages including, without limitation, damages incurred due to services provided via itself or its solution partners, incidental and consequential damages, personal injury or wrongful death, lost profits, or damages resulting from lost data or business interruption, regardless whether or not HBT or its solution partners has warned about the possibility of such damages.
IT IS RECOMMENDED THAT THE MEMBER READ ALL EXPLANATIONS HEREIN BEFORE CHOOSING TO BENEFIT FROM THE SERVICES PROVIDED BY HBT HOSPITAL. IN CHOOSING TO DO SO, THE MEMBER WILL HAVE UNDERSTOOD AND ACCEPTED THE SCOPE AND THE LIMITS OF THE SERVICES, AND THE POTENTIAL RISKS LIKELY TO ARISE.
CONSENT OF THE MEMBER TO UPLOAD THE INFORMATION IN THE SYSTEM
The members who wish to benefit from consultancy services may, at their will, upload their health information, for instance, lab and test results or any other medical documents, to the system, for the purpose of sharing with the health staff, in the phase of making an appointment. In so doing, the members accept to have explicitly consented their uploaded documents to be viewed, registered, arranged and classified HBT Hospital, its solution partners and the health staff.
In respect of the services provided via HBT Hospital, the virtual communications are not recorded. The documents which have been uploaded to the system for the purposes of virtual communication, in the phase of making an appointment may be removed by the members at their will.
WARNINGS RELATED TO USE FOR MALICIOUS PURPOSE
Any of the below uses or attempted uses of HBT Hospital site is prohibited:
- for any unlawful, unauthorized, fraudulent or malicious purpose;
- that could damage, disable, overburden, or impair any server, or the network(s) connected to any server,
- to gain unauthorized access to any other accounts, computer systems or networks connected to any server or systems through hacking, password mining or any other means,
- to access systems, data or information not intended by HBT Hospital to be made accessible to a user,
- any use other than the business purpose for which it was intended, or
- any kind of cyber-attack.
In case of any use for malicious purposes as listed herein, HBT Hospital reserves the right to have recourse to any legal procedures, regardless of whether such malicious use is covered by the laws of the country where such malicious use has been performed, including all elements which take in elements of a crime, against the persons and institutions who have attempted to commit, supported, abetted, or have committed a crime, or to whom similar deeds and acts can be attributed.
HBT HOSPITAL ADOPTS THE PRINCIPLE TO RESPECT THE LAW, ETHICS, MORAL VALUES AND PERSONAL RIGHTS IN ITS OPERATIONS. IN USING HBT HOSPITAL, THE MEMBER, BY HIS OWN WILL, AGREES AND UNDERTAKES THAT THE CIRCUMSTANCES LISTED BELOW ARE OF MALICIOUS NATURE AND HE WILL NOT ACT IN SUCH A MANNER AS THAT IT IS COVERED BY THESE CIRCUMSTANCES:
a) Upload or transmit any message, information, data, text, software or images, or other content ("Material") that is against the law, international conventions, codes, legal, administrative and technical specifications, and which is harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, or otherwise objectionable, or that may invade another's right of privacy or publicity;
b) Create a false identity for the purpose of misleading others or impersonate any person or entity, including, without limitation, any HBT Hospital representative, or misrepresent your affiliation with a person or entity;
c) Upload or transmit any material that you do not have a right to reproduce, display or transmit under any law or under contractual or fiduciary relationships;
d) Upload files that contain viruses, trojan horses, worms, time bombs, cancel-bots, corrupted files, or any other similar software or programs that may damage the operation of another's computer or property of another;
e) Use HBT HOSPITAL’s communication features in a manner that adversely affects the availability of its resources to other users (e.g., excessive shouting, use of all caps, or flooding continuous posting of repetitive text);
f) Upload or transmit any unsolicited advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes" or any other form of solicitation, commercial or otherwise;
g) Violate any applicable local, state, national or international law;
h) Upload or transmit any material that infringes any patent, trademark, service mark, trade secret, copyright or other proprietary rights of any party;
i) Manipulate or otherwise display HBT Hospital by using framing, mirroring or similar navigational technology;
j) Register, subscribe, attempt to register, subscribe or unsubscribe any party for any services or any contests, or promotions if you are not expressly authorized by such party to do so;
k) Harvest or otherwise collect information about others, including e-mail addresses;
l) Use any robot, spider, scraper, or other automated or manual means to access HBT Hospital site, or copy any content or information on HBT Hospital.
k) Use any information about any users of HBT Hospital in an illegal matter.
HBT Hospital reserves the right to take whatever lawful actions it may deem appropriate in response to actual or suspected violations of the foregoing, including the immediate suspension or termination of the user's access or account. HBT may cooperate with legal authorities or third parties in the investigation of any suspected or alleged crime or civil wrong. HBT reserves the right at all times to disclose any information as HBT Hospital deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part.
HBT Hospital shall not be used for any malicious intention by any member against other members and third parties.
HBT Hospital may, in circumstances listed above, terminate any user’s membership and reserves the right to take whatever legal actions in response to any damages caused or likely to be caused by itself and third parties.
DATA AND INFORMATION
HBT Hospital reserves the right to renewal, update and upgrade all information and software systems. We still would like to remind you that there are no systems, which can guarantee 100% security from hackers or malware, leading to the misuse or sharing of confidential medical information you have provided us. In choosing to use HBT Hospital, the members acknowledge any potential risks for any hacking of their data, mistakes, or errors regarding their personal information on HBT Hospital database.
HBT Hospital does not disclose the member’s information or data, without the member’s approval and knowledge. The members, however, acknowledge that the disclosure of their information or data may be requested without their consent in the phase of disclosure or request in circumstances as written below:
a) if and when required by law,
b) for public health activities,
c) for victims of abuses, neglects, or domestic violence,
d) for health oversight activities,
e) for legal and administrative proceedings,
f) for the purpose of law enforcement,
g) for functions concerning deceased persons, such as identification,
h) for research purposes, if certain conditions are fulfilled,
i) to prevent or lessen a serious threat to health or safety,
j) for essential government functions,
k) for workers compensation.
The member accepts that HBT is not responsible for any breach of its security systems that may affect him. HBT is not responsible for any loss of data or information.
PRIVACY STATEMENT
HBT requests the members who wish to benefit from the system to determine a unique username and password which may not be easily revealed by others, in order to maintain the privacy of their own information. It is strongly recommended for the members to keep the password to their self only, it is in their own initiative to keep the information private.
HBT, is not liable for any loss or damages that may be incurred by the members due to any usage of their own account or password by others. However, the members may, in such case, be liable for any loss and damages incurred to HBT or third parties.
The members, therefore, agree to:
- immediately notify HBT Hospital in written, of any unauthorized use of their account or any other breach of security of which they become aware, and
- exit securely from their account at the end of each login.
DISPUTE SETTLEMENT
Any claims arising regarding the use of HBT Hospital must be brought within one (1) year as from the date of the event giving rise to such action occurred. The member accepts and declares that the use of the website is predicated upon his waiver of any right to participate in a class action suit for any losses or damages resulting from his use of the website.
In case of any differences or discrepancies in terms of meaning or the content between the texts written in different languages regarding the terms & conditions, English text shall prevail.
CANCELLATION / REFUND POLICY
If the member is not able to attend a scheduled consultation with a healthcare professional or needs to cancel the request for consultation or second opinion, we kindly remind that the member should contact the administration by mail ([email protected]) at least 24 hours before the appointment.
Timeless cancellations may jeopardize our ability to provide the medical assistance our members need to receive at the right time.
Cancellation Policy based on timing is at following;
- We do not provide any refund if the member does not attend the appointment which is approved by doctor or the healthcare professional and finalized.
- If the doctor or the healthcare professional cannot attend the appointment, there will be no decrease in your package and a new appointment will be planned as soon as possible.
- If the member cancels the appointment 24 hours before the appointment, the right will be reserved. Our members who purchased a single consultation can use their right on a different doctor or a healthcare professional.
RESCHEDULING
The member will be permitted to reschedule an appointment with the same healthcare staff personnel only three times, within 24 hours prior to your appointment date. The healthcare staff associated with HBT have the right to reschedule an appointment at all times.
ABOUT SERVICES OTHER THAN MEDICAL
The tourism agency is responsible for all kinds of activities, excluding the treatment, from the start of the treatment to Turkey (air tickets, transfers, package tours, hotel, motel, eating and similar services) until the member leaves Turkey, HBT Hospital does not accept any responsibility.
